Federal and state laws cause a lot of confusion regarding marijuana, hemp, and everything in between.

Delta 8 THC is one of the more recent hemp products to register on the government’s radar. Federally, it’s legal to buy, sell, and use; however, many states contradict that with legislation.

Nevada is one of the few states to ban delta 8 THC.

We’ll go over the laws surrounding delta 8 THC in Nevada.

We’ll also cover what delta 8 THC is and how it’s different from delta 9 THC, how to use delta 8 THC products, and where you can buy them in Nevada.

Is Delta 8 THC Legal in Nevada?

No, delta 8 THC is illegal in the state of Nevada.

The ground-breaking 2018 Farm Bill made an important distinction between cannabis and hemp. According to this bill, hemp is defined as cannabis with 0.3% or less delta 9 THC and makes all hemp and hemp-derived products (including delta 8 THC) legal.

However, states still retain the power to make different laws and regulations regarding these products.

Nevada is a cannabis-friendly state and allows delta 9 THC use regardless of its origin or concentration. However, Nevada banned delta 8 THC.

In Nevada, delta 8 products are illegal. You won’t find any of these products in the state whether you search online or in dispensaries.

If you could get these products in the state, the best option by far would be to buy online.

The benefits of ordering delta 8 THC online include:

  • Online shops have better pricing and seasonal discounts
  • When you buy online you can read customer reviews & third-party tests before you buy
  • Ordering online is easier and more convenient
  • Online shops have a greater selection of products
  • Products left on store shelves degrade more quickly

Do I Need a Medical Card in Nevada to Order Delta 8 THC?

Given that delta 8 THC is banned in the state — even for medical purposes — you can’t get a medical card for it in Nevada.

What About Delta 10 THC?

Delta 10 THC falls under the same laws and regulations as delta 8 THC, making it illegal in Nevada.

What’s the Difference Between Delta 8 THC & Delta 9 THC?

Chances are you’ve already heard of THC, the compound in cannabis responsible for getting you high. Usually, when people talk about THC, they mean delta 9 THC — one of three isomers of this molecule.

Isomers are compounds with very similar chemical structures, with slight differences that lead to slightly different effects. The other two isomers of delta 9 THC are delta 8 and delta 10 THC.

Interestingly, in the case of these molecules, those slight differences in chemical structure are responsible for different effects and different legal classifications.

While delta 9 is illegal at the federal level, delta 8 and 10 are not. However, some states have made one or both illegal.

Delta 8 THC is a phytocannabinoid found in minimal concentrations in cannabis — less than 1%. This is because delta 8 is merely a by-product of delta 9 THC chemical degradation.

Delta 9, contrarily, is found in concentrations up to 30%. When exposed to environmental factors, such as UV light and heat, it naturally degrades into delta 8 THC.

Another important difference is potency. Delta 8 has roughly half the strength of delta 9 when it comes to cognitive effects.

Choosing between the two obviously starts with which (if any) are legal in your state; aside from that, how do you pick one over the other if they have such similar effects?

First, you need twice the amount of delta 8 to get the same high as you would with delta 9 — however,  delta 8 leads to fewer side effects, like anxiousness, and is more mellow.

Moreover, since you need a greater amount to get the same effect, you’re less likely to use too much delta 8 by accident and get undesired side effects. However, delta 8 is considerably more expensive than delta 9.

Finally, you develop tolerance to delta 8 faster, but you can also regain it quicker.

Is Delta 8 THC Safe?

As previously mentioned, you need twice the delta 8 THC to get the same psychotropic effects as delta 9, which makes it much safer.

Additionally, delta 9 comes with more severe side effects than delta 8, including paranoia, making delta 8 a safer alternative.

How to Use Delta 8 THC

Delta 8 THC products are super easy to use, and there’s something for everyone — both when it comes to taste and lifestyle. If you’ve previously used CBD products, you already know how to use delta 8 equivalents. Don’t worry if you didn’t know how to use it; we got you covered; read this guide here.

Here are a few examples of the most common delta 8 THC products, their advantages and disadvantages, and how to use them.

1. Delta 8 THC Oils & Tinctures

Delta 8 THC oils and tinctures are super easy to use:

  • Ingest them
  • Add them to food or drinks
  • Hold them under your tongue for 30 to 60 seconds before swallowing

This makes them some of the most versatile options for consuming delta 8 THC. Here at Area 52, we went ahead of the game and infused different unique flavors into our tinctures. So you can enjoy them more, check out our selection of flavored D8 tinctures.

By holding them under your tongue, you’ll get delta 8’s effects faster than when you ingest them either pure or mixed with food or beverages — this way, it’ll take at least 30 minutes.

The main difference between oils and tinctures is the ingredients in their composition. Tinctures have elements that increase their bioavailability — your body can absorb and process them faster.

2. Delta 8 THC Distillates

Distillates are another versatile way to consume delta 8 THC. You can:

  • Eat it
  • Vaporize and inhale it
  • Smoke it with a dab rig

The last two are the most popular way of using distillates, and you’ll get the effects much faster — in ten minutes or less.

Know that distillates’ color can vary from clear to light brown, so there’s no reason to worry if you get different colors from different brands or batches.

3. Delta 8 THC Edibles

Edibles work the same way as oils, tinctures, and distillates since you ingest them. The effects take at least 30 minutes to show up, but it can take longer — wait at least one hour before having your second dose.

The most common delta 8 edibles are capsules and gummies. We included these 3 flavors: green apple, mango, and strawberry, in our Assorted D8-infused gummies. So you can have fun trying out those delicious flavors. Additionally, both are a great alternative to oils and tinctures if you don’t like their taste or consistency or have difficulty dosing.

In fact, edibles’ most significant advantage is how easy they are to dose — each comes with a specified amount of delta 8, and you can have one or more to reach your ideal dosage.

4. Delta 8 THC Vapes

As previously mentioned, inhaling vaporized delta 8 is the fastest way to feel its effects — ten minutes maximum — which makes vaping the perfect option for urgent, quick effects.

To vape delta 8, you need to take a deep breath and hold the vapor in for as long as you want. You can easily and discreetly take your vape anywhere inside your bag or pocket.

The one disadvantage is that there’s a lack of delta 8 vape cartridges for some of the most popular vape models. However, you can:

  • Use pre-made disposable delta 8 vape pens
  • Use 8 mm threaded vape cartridges (the universal thread for e-vaporizer cartridges)
  • Get refillable pods for your vape model

We carry D8 THC vape carts and vape pen batteries. However, until delta 8 becomes legal in Nevada, we can no longer ship directly to this state.

5. Delta 8 THC Flower

The flower is the best option for cannabis lovers – you’ll get all the benefits of delta 8, just like with any other method, but still enjoy the cannabis scent and flavor since you use it as a regular marijuana flower. You can:

  • Smoke it with a pipe or bong
  • Incorporate it in joints or blunts
  • Vaporize it in a dry herb vape

Considering we’ve previously stated that you can only find delta 8 in concentrations lower than 1% in cannabis or hemp, you might be wondering how using a flower is a viable option.

Well, some companies are getting around this problem by aging cannabis flowers. By exposing it to environmental conditions, like UV light and oxygen, delta 9 THC naturally degrades into delta 8, increasing its concentration.

What’s the Future of Delta 8 THC in Nevada?

Nevada is one of the most cannabis-friendly states in the nation but still made delta 8 THC illegal. However, you can purchase delta 9 THC products unrestrictedly in the state as long as you’re 21 or older — there’s no need for a medical card.

You can purchase delta 9 THC products online or in physical stores as an alternative, but getting vape products delivered to you won’t be as easy as it used to be.

Aside from that, getting your products online is the best and most convenient option out there.

Considering the whole country seems to be moving towards the legalization of all cannabis products and that Nevada is a pro-cannabis state, we believe delta 8 THC will become legal at some point.
